Zoning Board of Appeals
Minutes of Meeting
January 6, 2011

In attendance:  AP, JS, PD, JD, PH, SF and DJ
LR
(MC absent)

7:00 PM

New – 7 Beaver Pond Road – Special Permit
        Mr. and Mrs. Felaco

AP read the request to withdraw the family apartment permit without prejudice.  

JS motion to accept.
DJ second.

All in favor to allow the applicant to withdraw their application.

Continuation – Map 64/Lot 212 South Center Realty

Sitting in:  JS, AP, PD, PH and JD

JS took over as chairman for the 40B continuation.

JS stated that the applicant has been continuing for quite some time.  The draft decision had been forwarded to all the board members and Town Counsel was in attendance to review it, comment or answer questions for the board and the public.  JS stated that the mitigation package was being discussed between Don Dimartino and the applicant.  The Board of Selectmen will sign that after Don reviews it.  AP asked if the board can make the February meeting the final date to sign the decision.  Town Counsel stated if there are some outstanding issues we could make an extra meeting at the end of February.  The goal is to sign in February.  The board members and Town Counsel reviewed, discussed and revised parts of the decision.  Town Counsel stated he would re-vise the decision with the comments the board had and get a copy back to each board member before the next meeting.  The board was agreeable and continued the hearing until February 3, 2011 at 7:00 PM.

AP motioned to continue to February 3, 2011 at 7:00 PM.
PD second.

All in favor to continue.
